DINGO Flow End User License Agreement

This End User License Agreement ("Agreement") governs installation and use of DINGO Flow - DICOM Ingest and Go ("DINGO Flow", the "Software"). By installing, copying, accessing, or using DINGO Flow, you agree to this Agreement. If you do not agree, do not install or use DINGO Flow.
1. Ownership
DINGO Flow is proprietary, copyright-protected software owned by Juan Pablo Devoto / DINGO. All rights not expressly granted in this Agreement are reserved.
This Agreement does not transfer ownership of DINGO Flow, documentation, trademarks, trade names, license controls, or other intellectual property.
2. License Grant
Subject to this Agreement and any separate written order, invoice, or license terms provided by DINGO, you are granted a limited, non-exclusive, non-transferable, revocable right to install and use DINGO Flow for your internal DICOM receiving, routing, transformation, delivery, monitoring, and operational review workflows.
Use of DINGO Flow requires a valid license issued by DINGO. DINGO Flow may limit operation when a valid license is not available, does not match the licensed environment, has expired, has been modified, or fails validation.
3. Restrictions
You may not, and may not permit any third party to:
- copy, redistribute, publish, sell, rent, lease, lend, sublicense, or transfer DINGO Flow except as expressly permitted in writing;
- operate DINGO Flow as a public, commercial, managed, or multi-tenant offering for third parties without written permission;
- modify, adapt, translate, merge, or create derivative works from DINGO Flow except as expressly permitted in writing;
- reverse engineer, decompile, disassemble, inspect, or attempt to derive source code, structure, algorithms, license checks, signing keys, or protection mechanisms except where such restriction is prohibited by applicable law;
- bypass, disable, tamper with, remove, or misrepresent DINGO Flow license controls, hardware identification, expiration checks, signatures, notices, or access controls;
- remove, obscure, or alter copyright, trademark, proprietary, legal, license, or attribution notices;
- use DINGO Flow in violation of applicable law, regulation, healthcare compliance obligations, network rules, imaging-system policies, or data protection requirements.
4. Operational Responsibility
DINGO Flow is an operational workflow tool for DICOM receiving, routing, transformation, delivery, monitoring, retention, and review. It does not replace professional judgment, clinical review, operational approval, data governance, audit requirements, backup procedures, disaster recovery planning, or independent validation.
You are responsible for:
- validating routing rules, destinations, transformations, alerts, and retention settings;
- confirming that delivery outcomes are complete and appropriate for your workflow;
- maintaining backups and operational recovery processes;
- complying with applicable privacy, security, healthcare, and data protection requirements;
- monitoring system resources, activity logs, delivery status, and operational outcomes.
5. Third-Party Components
DINGO Flow may include separately licensed third-party materials. Those materials are owned by their respective copyright holders and licensed under their own terms. This Agreement applies only to DINGO Flow and does not change, replace, limit, or expand any third-party license.
6. Confidentiality and Protection
DINGO Flow source code, license generation tools, signing keys, unpublished release materials, commercial terms, and technical protection details are confidential unless DINGO expressly states otherwise in writing.
You must use reasonable care to prevent unauthorized access, copying, disclosure, or distribution of DINGO Flow and any license files issued to you.
7. Termination
Your right to use DINGO Flow terminates automatically if you breach this Agreement, if your issued license expires, or if your license is revoked according to applicable written terms.
Upon termination, you must stop using DINGO Flow and remove DINGO Flow copies from your systems unless retention is required by law or expressly permitted in writing. Sections concerning ownership, restrictions, confidentiality, warranty disclaimer, limitation of liability, and third-party components survive termination.
8. Warranty Disclaimer
To the maximum extent permitted by applicable law, DINGO Flow is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, or uninterrupted operation.
DINGO Flow does not warrant that routing, transformations, deliveries, alerts, retention, reports, viewing, network operations, or third-party interactions will be error-free, complete, uninterrupted, or suitable for any particular clinical, regulatory, operational, or business purpose.
9. Limitation of Liability
To the maximum extent permitted by applicable law, DINGO and Juan Pablo Devoto will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, studies, goodwill, business interruption, system availability, or operational outcomes, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, DINGO's total cumulative liability for all claims arising from or related to DINGO Flow will not exceed the amount actually paid for the applicable DINGO Flow license during the twelve months before the event giving rise to the claim, or USD $100 if no amount was paid.
